These Terms of Use (“Terms”) govern your use of [DavidHolland.org] (the “Site”). Please read them carefully. By using the Site, making a donation, creating an account, or buying a product, you agree to these Terms.
The Site is operated by The Cup & Table Co., a Texas nonprofit corporation recognized as a 501(c)(3) tax-exempt organization, doing business as David Holland (“the Ministry”).
The Store section of the Site is operated by David A. Holland LLC, Texas for-profit limited liability company (“the Store Operator”). Purchases from the Store are commercial transactions and are not tax-deductible charitable contributions. The Store Operator — not the Ministry — is the seller and contracting party for any product purchased through the Store.
Donations made through the Site, outside the Store, go to the Ministry and may be tax-deductible to the extent allowed by law.
These Terms apply to both the Ministry and the Store Operator, each in its respective capacity.
You must be at least 18 years old to make a donation, create an account, or make a purchase. By using the Site, you represent that you are at least 18.

One-Time Donations
When you make a one-time donation, you authorize us to charge your payment method for the amount you specify. You will receive a receipt by email that meets IRS substantiation requirements for charitable contributions.
Recurring Donations
When you set up a recurring donation, you authorize the Ministry to charge your payment method on the schedule you select (for example, monthly). Recurring donations continue until you cancel them. There is no fixed end date unless you set one.

Cancellation takes effect immediately upon processing, meaning no further charges will be made. If a charge has already been processed before we receive your cancellation, that charge will stand. We will confirm your cancellation by email.
Refunds on Donations
Donations are generally non-refundable. We will, however, refund donations in the case of:

Tax Deductibility
The Ministry is a recognized 501(c)(3) organization. Donations are tax-deductible in the United States to the extent allowed by law. We do not provide tax advice. Consult your tax advisor about your specific situation.
Premium and Thank-You Gifts
If a donation comes with a premium or thank-you gift of more than nominal value, your tax deduction is limited to the donation amount minus the fair market value of what you received. We will disclose this on your receipt where applicable.
The Seller
When you buy a product from the Store, your contract is with the Store Operator, not the Ministry. Store revenue is not used to fund the Ministry’s operations and is not tax-deductible.
Pricing and Availability
Prices are listed in US dollars. We reserve the right to change prices, correct pricing errors, and limit quantities at any time. If we discover a pricing error after you’ve placed an order, we’ll contact you before processing — you can choose to confirm at the corrected price or cancel.
Shipping
We currently ship to U.S. addresses only. Shipping costs and estimated delivery times are shown at checkout. Risk of loss transfers to you when the carrier accepts the package.
Returns and Refunds
Physical products may be returned within 30 days of delivery for a full refund of the product price, provided they are in original condition. Return shipping is the customer’s responsibility unless the product was defective or sent in error.
Digital products (e-courses, downloads, devotionals delivered electronically) are non-refundable once accessed or downloaded, except in the case of a technical defect we cannot resolve.
Course Access and Digital Products
If you purchase access to an online course or other digital product, you receive a personal, non-transferable, non-exclusive license to access that content for [the term specified at purchase / as long as the course remains available]. You may not:

If you submit content to the Site — comments, prayer requests, testimonials, course discussions, community posts — you grant the Ministry a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with the Ministry’s work. You retain ownership of what you submit.
You are responsible for what you submit. Don’t submit anything that is unlawful, defamatory, infringing, or otherwise inappropriate. We may remove submissions at our discretion.
All content on the Site — text, devotionals, teaching, articles, audio, video, course materials, graphics, and design — is owned by the Ministry, the Store Operator, or licensed to us, and is protected by copyright and other intellectual property laws.
You may share short quotes with proper attribution and a link back to the Site, consistent with fair use. You may not reproduce, republish, or redistribute substantial portions of the content without our written permission. AI training, scraping, and bulk extraction are not permitted.
“David Holland,” “The Cup & Table Co.,” and related names and logos are marks of the Ministry.
Content on the Site reflects the Ministry’s pastoral, theological, and devotional teaching. It is not a substitute for professional medical, mental health, legal, financial, or tax advice. The Site may link to third-party websites or rely on third-party services (such as Stripe for payments or a separate platform for community or courses). We are not responsible for the content, policies, or practices of third parties. Your use of a third-party service is governed by that service’s own terms and privacy policy.
THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE MINISTRY, THE STORE OPERATOR, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT OR SERVICE OBTAINED THROUGH IT.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE MINISTRY OR STORE OPERATOR IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
You agree to indemnify and hold harmless the Ministry, the Store Operator, and their directors, officers, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any third party’s rights.
We may suspend or terminate your access to the Site, your account, or any service at any time, with or without notice, for any reason — including violation of these Terms. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. The “Last Updated” date at the top will reflect any changes. Material changes will be communicated through the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.
